PENALTIES FOR DRUG TRAFFICKING
The crime you will be charged with depends upon the substance and the weight.
Trafficking in a Class B Substance. (Cocaine, OxyContin, OxyCodone, Percocet, Klonopin, Benzodaizepine, Xanax, Alprazolam)
- 18 grams or more, but less than 36 grams, carries a mandatory minimum of 2 years state time up to 15 years max.
- 36 grams or more, but less than 100 grams, carries a mandatory minimum of 3 1/2 years state time up to 20 years max.
- 100 grams or more, but less than 200 grams, carries a mandatory minimum of 8 years state time up to 20 years max.
- 200 grams or more, carries a mandatory minimum of 12 years up to 20 years max.
Trafficking in a Class D Substance (cannabis, marijuana)
- 50 pounds or more, but less than 100 pounds, carries house time mandatory minimum of 1 year up to 2 1/2 years; or state time mandatory minimum of 2 1/2 years up to 15 years max.
- 100 pounds or more, but less than 2,000 pounds, carries a mandatory minimum of 2 years state time up to 15 years max.
- 2,000 pounds or more, but less than 10,000 carries a mandatory minimum of 3 1/2 years state time up to 15 years max.
- 10,000 pounds or more, carries a mandatory minimum of 8 years state time up to 15 years max.
